These Terms of Service ("Terms") govern access to and use of Tracksmails, a click-tracking, attribution, campaign-management, reporting, and server-to-server postback platform developed and operated by CAR N DRIVE PRIVATE LIMITED ("Tracksmails," "we," "us," or "our"). By creating an account or using Tracksmails, you agree to these Terms.
Tracksmails provides tools for creating tracking links, recording clicks and conversions, measuring campaign performance, managing advertisers, publishers, offers, campaigns, domains, and postbacks, and sending or receiving server-to-server conversion notifications.
Features, limits, pricing, trial periods, and availability may vary by account or plan.
You are responsible for maintaining accurate account information, protecting passwords and API or postback credentials, and restricting access to authorized users. You are responsible for activity performed through your account or workspace.
Tracksmails may review new workspace registrations before activation and may suspend or restrict access where reasonably necessary for security, fraud prevention, non-payment, policy enforcement, or legal compliance.
You are responsible for the advertising campaigns, destinations, advertisers, publishers, parameters, and integrations you configure in Tracksmails. You must have the right and lawful basis to collect, transmit, receive, and process the information routed through your tracking links and postbacks.
You must comply with the policies of advertising platforms and traffic sources you use, including destination, transparency, consent, data use, misrepresentation, and tracking requirements.
Tracksmails supports transparent tracking configurations in which an immediate next-hop destination is provided in the tracking request. The primary transparency parameter used by Tracksmails is redirect_url; supported integrations may also use force_transparent=true as a secondary control parameter.
Customers must not use Tracksmails to disguise, misrepresent, or evade an advertising platform's destination requirements. The landing page and tracking configuration used in an advertising campaign must comply with the applicable platform's policies.
You may not use Tracksmails to:
As between Tracksmails and the customer, the customer retains its rights in campaign, advertiser, publisher, destination, conversion, and other data it supplies to Tracksmails. You grant us the rights necessary to host, process, transmit, secure, and display that data solely to operate the service and meet our legal obligations.
Our processing of personal information is also governed by the Tracksmails Privacy Policy.
If you select a paid plan, fees and billing terms shown during checkout or in your account apply. Recurring subscriptions may renew automatically until cancelled according to the applicable billing terms. Payment processing may be provided by a third-party payment processor.
Where the product provides a grace period following trial or payment expiration, the availability of tracking, dashboard, reporting, or management functions during that period may differ. We may change grace-period behavior with reasonable notice where operationally practical.
We may update, add, remove, or modify features and may perform maintenance. We aim to provide a reliable service but do not guarantee uninterrupted or error-free operation.
We may suspend or terminate access where reasonably necessary due to material violation of these Terms, fraud, abuse, security risk, non-payment, legal requirements, or conduct that threatens Tracksmails or other users. You may stop using the service and, where available, cancel your subscription through your account or by contacting us.
Tracksmails may interoperate with advertising platforms, payment processors, email providers, advertiser systems, publisher systems, or other third-party services. Those services are governed by their own terms and privacy practices. References to third-party products do not imply sponsorship, certification, or endorsement unless explicitly stated.
Tracksmails, its software, design, documentation, trademarks, and related product materials are owned by CAR N DRIVE PRIVATE LIMITED or its licensors, except for customer data and third-party materials.
To the maximum extent permitted by applicable law, Tracksmails is provided on an "as is" and "as available" basis. We do not guarantee advertising approval, campaign performance, conversion volume, revenue, or acceptance by any third-party advertising platform.
To the maximum extent permitted by applicable law, CAR N DRIVE PRIVATE LIMITED and its personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, or data arising from use of the service.
We may update these Terms from time to time. The current version will be posted on this page with an updated revision date. Continued use of Tracksmails after updated Terms become effective constitutes acceptance where permitted by law.
